Moving from Alabama to Washington: Residency, Taxes, and What to Prove

Alabama's 5.00% top income tax rate becomes 9.9% (phasing in 2028; no general wage income tax before then) in Washington. This move trades a lighter tax environment for a heavier one, so timing income around the transition year matters.

Residency Tests Side by Side

Alabama uses a 213-day statutory residency threshold, while Washington uses 183 days. Track both thresholds separately during a transition year rather than assuming they line up.

FactorAlabamaWashington
Statutory Residency TestAlabama Administrative Code r. 810-3-2-.01 presumes an individual is an Alabama resident, even without domicile, if they maintain a permanent place of abode in Alabama and spend more than a total of seven months (not a simple 183-day count, and not required to be consecutive) in the state during the tax year. This is a materially higher bar than most 183-day states, since seven months is roughly 213 days. For the capital gains excise tax under RCW 82.87.020, a 'resident' is either (a) an individual domiciled in Washington during the taxable year, subject to a narrow safe harbor, or (b) an individual who maintained a place of abode in Washington and was physically present in the state for more than 183 days during the taxable year, regardless of domicile. Washington counts any portion of a calendar day present in the state as a full day for this 183-day count.
Domicile TestAlabama regulation defines domicile as the home, the fixed place of habitation, distinct from residence, which is described as a transient place of dwelling. An individual has only one domicile at a time; it continues until a new one is established and the old one is abandoned. Individuals domiciled in Alabama are taxed on worldwide income regardless of physical presence during the tax year, and the burden of proof for a change of domicile rests entirely on the taxpayer, including for federal employees and military personnel who remain presumptively Alabama residents until they prove the change.Washington Department of Revenue guidance and case law define domicile as residence in fact coupled with the intent to make that place your permanent home; once established, domicile continues until superseded by a new one, and the burden of proving a change falls on the person asserting it. Selling the old home or buying a new one is not, by itself, conclusive; DOR and the courts look for substantial evidence of an actual, present change, not merely a stated future intent.
Day Count Threshold213 days183 days
Any Part of a Day RuleNot addressed with a published carve-out list; the seven-month presumption is based on cumulative months of presence with a maintained permanent place of abode rather than a strict any-part-of-a-day count, which is a materially different mechanic from the day-counting states.Yes. Washington's capital gains tax statute treats any portion of a calendar day physically present in the state as a full day toward the 183-day count, the same aggressive counting method California uses.

Leaving Alabama

High exit scrutiny (3/5)

Practitioner commentary (Bradley Arant Boult Cummings, via the Alabama Society of CPAs) describes an increased number of residency audits by the Alabama Department of Revenue (ALDOR) in recent years, referencing a 2023 Alabama Tax Tribunal ruling on change-of-residency requirements. ALDOR commonly identifies audit targets through its information-sharing agreement with the IRS: a federal return showing an Alabama address with no corresponding Alabama state return filed, or a W-2 listing an Alabama address without a matching state filing, are the two triggers specifically named in that commentary. As with most states, the taxpayer bears the burden of proof once ALDOR or another state initiates a residency challenge.

Trailing Income

Alabama taxes Alabama-source income (wages for work performed in-state, income from Alabama businesses or property) earned by nonresidents after departure under standard nonresident-sourcing rules; no Alabama-specific deferred-compensation or stock-option clawback provision distinct from ordinary multistate sourcing was identified in this research.

Part-Year Filing

A taxpayer who terminates Alabama residency during the year must notify ALDOR of the termination and file Form 40 reporting income for the resident portion of the year; if Alabama-source income continues after departure, a nonresident return (Form 40NR) is also required for that income.

Enforcement Methods

IRS/ALDOR information-sharing match of federal returns with Alabama addresses against Alabama state filing records
W-2 address matching against state return filings
seven-month presumption applied based on maintained abode plus cumulative days present

Common Exit Mistakes

filing a federal return with an Alabama address while failing to file the corresponding Alabama state return for the same year, which is one of the two specific patterns practitioners say now triggers an ALDOR residency audit
assuming departure is complete once under the seven-month threshold, without addressing domicile, since domicile alone (independent of the seven-month presumption) is sufficient for Alabama to keep taxing worldwide income
federal employees and military personnel assuming a change of station or new posting alone changes their Alabama domicile; the regulation keeps them presumptively Alabama residents until they affirmatively prove the change

Declaration of Domicile

Washington has no formal declaration-of-domicile filing. Domicile is established through conduct and intent under the common-law standard applied in Washington Supreme Court precedent and DOR's capital gains tax domicile guidance.

Homestead

Washington's homestead exemption is automatic, no filing required, and protects the greater of $125,000 or the county median sale price of a single-family home from most creditors under RCW 6.13. In practice the county median controls almost everywhere, since it routinely exceeds $125,000 (King County's median alone was around $968,300 in the most recent published data).

New Resident Tax Traps

New residents moving to Washington face no general wage income tax, but anyone with significant unrealized long-term capital gains needs to understand that Washington's capital gains excise tax applies based on domicile at the time of a sale, meaning a large stock sale executed after establishing Washington domicile is Washington-taxable even if the gain accrued almost entirely while living elsewhere. High earners should also plan for the 2028 Millionaires' Tax on income over $1 million, which begins applying to Washington residents and Washington-source income for nonresidents starting tax year 2028.

What Changes on Tax

Alabama Top Rate

5.00%

Washington Top Rate

9.9% (phasing in 2028; no general wage income tax before then)

Moving from Alabama to Washington raises the top marginal income tax rate from about 5% to about 9.9%, an increase of roughly 4.9 percentage points.

Withholding Reciprocity

Alabama and Washington do not have a wage-withholding reciprocity agreement with each other, so this move follows ordinary source-state and resident-state filing rules rather than a reciprocity exception.

Community Property Transition

Alabama uses common law marital property rules and Washington is a community property state. Property acquired during marriage after the move may be characterized differently going forward, which matters for estate planning and for basis step-up on a spouse's death.

Beyond Income Tax

Alabama

Capital gains: Taxed as ordinary income at the standard graduated rates; Alabama has no separate, lower capital gains rate.

Estate or inheritance tax: None. Alabama has no estate tax and no inheritance tax.

Property tax: Alabama's effective property tax rate on owner-occupied housing is about 0.37%, one of the lowest in the country. Homeowners 65 and older who own and occupy a single-family home receive a full exemption from state property tax; county-level exemptions for seniors are separate and income-tested, up to $5,000 of assessed value for those with federal adjusted gross income under $12,000, and up to $2,000 for higher earners.

Sales tax: 4% state rate, but Alabama's local option sales taxes are among the highest in the country, pushing the average combined state-and-local rate to about 9.46%, among the top rates nationally.

Washington

Capital gains: Washington's capital gains excise tax (RCW 82.87) taxes long-term capital gains at 7% on the first $1 million above the annual standard deduction ($270,000 range, indexed) and 9.9% above $1 million. It exempts real estate sales entirely, gains inside qualified retirement accounts, and gains from the sale of a qualifying small business meeting ownership and revenue tests. For stock and other intangible property, the tax applies based on the seller's domicile at the time of sale, not physical presence.

Estate or inheritance tax: Washington has a state estate tax with a filing threshold and exclusion amount of $3,000,000 to $3,076,000 for decedents dying in 2026 depending on the exact date, and graduated rates up to 20%, among the highest top estate tax rates of any state. There is no separate inheritance tax.

Property tax: Effective rate is roughly 0.81% to 0.94% depending on the source and county, close to but slightly below the national average, with no broad homestead portability program comparable to California's Proposition 19.

Sales tax: 6.5% state base rate, averaging about 9.51% combined with local rates; Seattle runs around 10.35%.

Who This Move Applies To

Travel Nurses

In Alabama

Alabama's major hospital systems (UAB in Birmingham, Huntsville Hospital) are significant travel-nursing markets. Because Alabama's presumption threshold is a cumulative seven months rather than 183 days, a nurse needs to track total months of Alabama presence across contracts within the tax year against that higher bar, while remembering that maintaining a permanent place of abode in Alabama is a separate condition of the presumption, not an automatic trigger from days alone.

In Washington

Seattle-area hospital systems are a major travel nursing market. Because Washington has no general wage income tax, a genuine Washington tax home creates no state income tax exposure on stipends or wages earned in Washington, though nurses still owe nonresident tax in every other income-tax state where they take assignments. The same tax-home substantiation rules apply: an actual, regularly used residence with duplicated living expenses, not just a mailing address.

Professional Athletes

In Alabama

Alabama has no major-league professional sports franchise, so its jock-tax exposure runs entirely through visiting athletes and, more prominently, college athletics: NIL (name, image, likeness) income earned by student-athletes at Alabama's major programs is Alabama-source income subject to the state's standard individual income tax rates, an increasingly relevant issue as NIL payments have grown.

In Washington

The Seahawks, Mariners, Sounders, and Kraken are all based in Washington, and for decades Washington's lack of a personal income tax made contracts here worth more after-tax than identical contracts in California or New York, since athletes owed no state tax on the home-state portion of their income. That advantage has a hidden cost: because Washington historically had no income tax, athletes domiciled here got no tax credit to offset the jock tax other states charged them for road games, making those out-of-state payments a pure additional cost rather than an offset against home-state liability. The 2028 Millionaires' Tax will itself begin reaching a portion of highly paid athletes' income domiciled in Washington.

Snowbirds, Long Visitors, and RVers

In Alabama

Alabama's Gulf Coast (Gulf Shores, Orange Beach) draws seasonal visitors, but the seven-month presumption is a materially higher bar than the 183-day rule used in most other states, meaning a snowbird can stay considerably longer in Alabama than they could in a 183-day state before triggering the statutory presumption, though genuine domicile-based residency remains possible even for a shorter stay if the person's conduct shows intent to make Alabama home.

In Washington

The relevant test for a long-term visitor isn't Washington's general tax system, since there is none for ordinary wages, but the 183-day physical-presence-plus-abode test and the 30-day safe harbor under the capital gains excise tax. Someone who keeps a Washington vacation home and visits often needs to track their day count carefully if they have appreciated stock or other intangible property they might sell, since crossing 183 days while maintaining a Washington abode can make them a Washington resident for that tax even without ever forming domiciliary intent.

Remote Workers

In Alabama

Alabama has no convenience-of-the-employer rule. A remote worker physically performing work from Alabama for an out-of-state employer owes Alabama tax on that Alabama-source income under the state's standard sourcing rules; Alabama's full federal-income-tax deduction can meaningfully soften the effective state tax rate compared to states without that deduction.

In Washington

Washington has no convenience-of-employer rule and, until 2028, no general wage income tax at all, making it one of the most attractive states for remote workers regardless of where their employer is based. The capital gains excise tax and the incoming Millionaires' Tax are the only state-level income taxes that reach a remote worker's earnings, and both turn primarily on domicile rather than employer location.

Military

In Alabama

Alabama follows the federal Servicemembers Civil Relief Act and Military Spouses Residency Relief Act, but its own regulation is notably taxpayer-unfriendly on the presumption side: federal employees and military personnel domiciled in Alabama remain presumptively Alabama residents, taxed on worldwide income, until they affirmatively prove a change of domicile, meaning a permanent change of station alone does not end Alabama tax residency without proof of genuine domicile abandonment. Alabama fully exempts military retirement pay from state income tax, a significant draw for the state's sizable veteran population given its bases (Redstone Arsenal, Maxwell-Gunter, Fort Novosel).

In Washington

Washington follows the federal Servicemembers Civil Relief Act and Military Spouses Residency Relief Act. Naval Base Kitsap and Joint Base Lewis-McChord are major installations, and because Washington has no general wage income tax, service members and spouses electing Washington domicile under MSRRA owe no state tax on military pay or spousal wage income today.

Airline Crew

In Alabama

Alabama has a smaller commercial airline crew base than its neighbors, concentrated around Birmingham-Shuttlesworth. Federal law (49 U.S.C. § 40116) limits state taxation of air carrier employees to their state of residence and, narrowly, a state where more than 50% of pay is earned; crew domiciled in Alabama are taxed on their full wages under the state's standard resident rules.

In Washington

Seattle-Tacoma International Airport (SEA) is a major hub and crew base for Alaska Airlines and Delta. Federal law (49 U.S.C. §40116) limits taxation of air carrier employees to their state of residence and any state where they earn more than 50% of pay; because Washington has no general wage income tax, Washington-based crew owe no state tax on their wages today regardless of this federal carve-out, though the 2028 Millionaires' Tax may eventually intersect with it for the highest earners.

Alabama to Washington FAQ

Does Alabama use the same 183-day rule as other states?+

No. Alabama's threshold is higher: a non-domiciled individual is presumed a resident only if they maintain a permanent place of abode in Alabama AND spend more than seven cumulative months (roughly 213 days, not required to be consecutive) in the state during the tax year, which is a materially higher bar than the 183-day rule used elsewhere.

Does Washington have a state income tax?+

Not a general wage income tax, no, and that has never changed. But Washington does tax long-term capital gains above a threshold at 7% to 9.9%, has a state estate tax, and enacted a new 9.9% tax on household income over $1 million starting in 2028. So 'no income tax' is no longer the complete picture for high earners.

I filed my federal return with an Alabama address but didn't file an Alabama state return. Is that risky?+

Yes, practitioners specifically identify this as one of the patterns the Alabama Department of Revenue now catches through its information-sharing agreement with the IRS, along with a W-2 listing an Alabama address with no matching state filing. Both are described as active triggers for the increased number of residency audits ALDOR has been conducting.

What is Washington's Millionaires' Tax and when does it start?+

SB 6346, signed in 2026, imposes a 9.9% tax on Washington taxable income over $1 million per household, applying to residents, part-year residents, and nonresidents with Washington-source income. It takes effect January 1, 2028, with the first returns due in 2029. It faces an announced constitutional challenge and possible voter referendum, so whether it survives intact is not yet settled.

Does Alabama tax my Social Security or pension when I retire here?+

Social Security is fully exempt, as is qualifying defined-benefit pension income (including Teachers' Retirement System and similar plans). Withdrawals from 401(k)s and IRAs, however, are taxed as ordinary income at Alabama's standard graduated rates, 2% to 5%, with no special exclusion.

Can I avoid Washington's capital gains tax just by moving out before I sell my stock?+

Only if you've actually changed your domicile before the sale, not just your address. Washington's capital gains tax sources stock and intangible property gains to your domicile at the moment of sale, and Washington courts require substantial evidence of a real, present change, not a stated future intent. Selling your Washington home or buying a new one elsewhere is not, by itself, conclusive proof you've moved.

I'm active duty military and Alabama was my home of record. Does a new duty station end my Alabama tax residency?+

Not automatically. Alabama's own regulation keeps federal employees and military personnel who are domiciled in Alabama presumptively Alabama residents, taxed on worldwide income, until they affirmatively prove a change of domicile. A permanent change of station alone is not enough; you need to show you genuinely established a new domicile and abandoned Alabama.

What is Washington's 30-day rule?+

It's a narrow safe harbor for people already domiciled in Washington: if you maintain no place of abode in Washington, maintain a permanent place of abode elsewhere, and spend 30 days or fewer in Washington for the entire tax year, you can be treated as a nonresident for the capital gains tax. Missing any one of the three conditions voids the whole safe harbor, and even if it applies, it changes your residency status only, not your domicile for purposes of sourcing a stock sale.

What form do I file for the year I move out of Alabama?+

Notify ALDOR of the termination of Alabama residence and file Form 40 for the portion of the year you were an Alabama resident. If you continue earning Alabama-source income as a nonresident after the move, you'll also need Form 40NR for that income.

Does Washington's 183-day rule work the same way as California's day count?+

Similarly, yes. Washington counts any portion of a calendar day physically present in the state as a full day toward the 183-day threshold under the capital gains tax statute, the same aggressive any-part-of-day approach California uses for its own residency analysis.

How does Alabama's homestead exemption compare to Florida's?+

Much smaller in dollar terms because Alabama's effective property tax rate is already very low, about 0.37%. The meaningful benefit is age-based: owner-occupants 65 and older get a full state property tax exemption, with additional income-tested county exemptions. It functions more as domicile evidence in a dispute than as a major tax-savings mechanism the way Florida's Save Our Homes cap does.

Does Washington tax retirement accounts?+

No. Gains realized inside qualified retirement accounts like 401(k)s and IRAs are explicitly exempt from Washington's capital gains excise tax, and Washington has never had a general income tax on pension or retirement account distributions.

Considering the reverse move?

Washington to Alabama

Moving the other direction is a different fact pattern, not a mirror image: exit risk and establishment mechanics both flip.
