With a new 9.15% top rate now applying to income over $1M, Maine has a fresh, direct revenue incentive to scrutinize high earners who claim to have left mid-year, especially those who kept a Maine home rather than sold it.

Trailing Income

Maine taxes Maine-source income earned by nonresidents, including work performed in Maine, business income from Maine sole proprietorships/partnerships/S-corps, capital gains on Maine real or tangible property, Maine rental income, and (since July 2005) certain gains on the sale of a partnership interest connected to Maine. It generally does not reach a nonresident's interest, dividends, alimony, or pension income unless tied to a Maine business. Active-duty military pay for service performed outside Maine under written orders is exempt even for a resident service member.

Part-Year Filing

Declaration of Domicile

Arizona has no formal declaration-of-domicile filing. Domicile is shown through conduct: purchasing or leasing an Arizona home, obtaining an Arizona driver's license, registering to vote, and opening Arizona bank accounts.

Homestead

Arizona's homestead exemption automatically protects up to $425,200 (as of January 2025, adjusted annually for inflation under ARS §33-1101) of equity in a primary residence from most creditors, with no filing required. Because it's automatic and adjusts every year, it's a weaker domicile-evidence signal than a state requiring an affirmative recording, but ADOR and other agencies can still cross-check ownership records against claimed nonresident status.

New Resident Tax Traps

Arizona taxes a new resident's worldwide income starting the date residency begins, requiring the Form 140PY apportionment for the year of the move. Because Arizona closely conforms to federal adjusted gross income, most federal timing issues around moving (like relocation-related deferred compensation) flow directly onto the Arizona return without separate state-specific adjustment.

Withholding Reciprocity

Beyond Income Tax

Maine

Capital gains: Taxed as ordinary income with no special Maine exclusion or preferential rate; a capital gain is included in Maine taxable income the same way wages are and is subject to the same brackets, including the new 2% surcharge if total income crosses the $1M/$1.5M threshold.

Estate or inheritance tax: Maine has an estate tax but no separate inheritance tax. The 2026 exemption is $7,160,000 per estate (indexed annually), with graduated rates of 8% to 12% on the excess above that threshold. Estates between roughly $7.16M and the much higher federal exemption owe Maine tax with no corresponding federal liability.

Property tax: Average effective rate is roughly 1.09% of home value. The Homestead Exemption reduces the taxable value of a primary Maine residence by $25,000, but only after the owner has held Maine permanent residency for at least 12 months, which makes it a lagging rather than immediate piece of domicile evidence for a brand-new resident.

Sales tax: 5.5% state rate with no additional local option sales tax anywhere in Maine, so 5.5% is also the effective rate statewide; most groceries and clothing are exempt.

Arizona

Capital gains: Taxed as ordinary income at the flat 2.5% rate, but Arizona allows a 25% subtraction on qualifying net long-term capital gains (ARS §43-1022), which brings the effective rate on those gains down to about 1.875%. As of January 1, 2026 the subtraction applies to all qualifying long-term gains, not just assets acquired after 2011. Short-term gains get no subtraction and are taxed at the full 2.5%.

Estate or inheritance tax: None. Arizona has no estate tax and no inheritance tax.

Property tax: Effective rate is among the lowest in the country, roughly 0.45% to 0.56% depending on county, with Maricopa County near the higher end. Arizona offers a Senior Property Valuation Protection option that freezes the assessed value for qualifying low-income seniors 65 and older, rather than a general homestead portability system.

Sales tax: 5.6% state transaction privilege tax base rate, with combined state-and-local rates commonly running 8% to 9% in metro Phoenix and up to about 11.2% in some jurisdictions.

Who This Move Applies To

Travel Nurses

In Maine

Maine's own guidance addresses a functionally identical fact pattern (Example 2: a merchant mariner who works away for months but always returns to his Maine home and family) and concludes the person stays a full-year Maine domiciliary. A travel nurse who claims Maine as a tax home should expect the same logic: the Maine home has to be a genuine, continuously maintained household that the nurse actually returns to, not just a mailing address, or MRS-style scrutiny (and the underlying IRS tax-home rules) will treat it as abandoned.

In Arizona

Arizona's Phoenix and Tucson hospital systems make it one of the largest travel nurse markets in the country. A nurse who is actually Arizona-domiciled and takes Arizona contracts is simply an Arizona resident under ordinary rules. A nurse who claims Arizona as a tax home while working travel assignments elsewhere needs a genuine, regularly used Arizona residence with duplicated living expenses, or the stipend portion of their pay risks being reclassified as taxable wages if audited.

Professional Athletes

In Maine

Maine has no major professional sports franchises, so it runs no state-specific jock-tax apportionment regime. A Maine-domiciled athlete is taxed on worldwide income (subject to credits for tax paid to other states on away-game duty days) but faces no in-state team creating reciprocal audit interest the way New York or California teams do for their opponents.

In Arizona

Arizona is home to the Cardinals, Suns, Diamondbacks, and the Coyotes' successor tenant at Mullett Arena, and MLB's Cactus League spring training in March adds a significant block of extra duty days for every visiting team's roster. Arizona applies standard duty-day allocation to nonresident athlete income, but because the flat rate is only 2.5%, Arizona produces one of the lowest jock-tax burdens of any state that taxes athlete income at all.

Snowbirds, Long Visitors, and RVers

In Maine

This is the fact pattern Maine's guidance is built around. Keeping a year-round lakefront or coastal home while wintering in Florida triggers full statutory residency the moment Maine presence exceeds 183 days (MRS Example 4, almost 200 days in that example). Anyone claiming to have moved out but staying under 183 days needs contemporaneous records (planners, plane tickets, credit card receipts) to support the claim, per MRS's own recommendation. A seasonal camp used only for vacations, by contrast, does not count as a permanent place of abode at all.

In Arizona

This is Arizona's signature scenario: the state's own nine-month (roughly 274-day) presumption explicitly allows spending a large chunk of the year in Arizona without automatically becoming a resident. Large numbers of California and Midwest retirees winter in the Phoenix and Tucson areas from October through April while keeping their prior-state domicile, but they need to track their total Arizona days against the 274-day threshold and remember their origin state runs its own, separate presumption pointing the other direction.

Remote Workers

In Maine

Maine has no convenience-of-the-employer rule of its own. The main friction for a remote worker moving to Maine is on the origin-state side: if a former employer is based in a convenience-rule state (New York, for example), that state can still claim the wages are sourced there even though the work is now performed from Maine.

In Arizona

Arizona has no convenience-of-employer rule. A nonresident who performs all their work physically outside Arizona for an Arizona-based employer is not Arizona-taxed on those wages. Arizona also has a narrow reciprocal withholding exemption (Form WEC) with California, Indiana, Oregon, and Virginia: residents of those four states working in Arizona can request their Arizona employer withhold no Arizona tax, though the arrangement runs one direction and doesn't create general two-way income tax reciprocity.

Military

In Maine

Active-duty service members domiciled in Maine before deployment remain Maine domiciliaries while stationed elsewhere, and their Maine-source military pay for out-of-state service is exempt from Maine tax. For tax years starting in 2023, SCRA amendments let a married service member and spouse jointly elect any one of three states for tax residency: the service member's domicile, the spouse's domicile, or the permanent duty station. A nonresident spouse's Maine wages earned solely because they're with a service member on orders are not treated as Maine-source income.

In Arizona

Arizona follows the federal Servicemembers Civil Relief Act and Military Spouses Residency Relief Act. Nonresident military stationed in Arizona under orders don't become Arizona residents from the posting alone, and their military pay isn't Arizona-taxed if domiciled elsewhere. Arizona also fully exempts military retirement pay for its own domiciled veterans.

Airline Crew

In Maine

Maine has no major airline hub base, so the federal crew-taxation carve-out (49 U.S.C. § 40116, taxing crew wages only in the state of residence or a state where over 50% of pay is earned) applies but rarely comes up for Maine specifically; it matters mainly for crew who are domiciled in Maine while based out of a hub in another state.

In Arizona

American Airlines operates a major hub and crew base at Phoenix Sky Harbor (PHX). Federal law (49 U.S.C. §40116) limits taxation of air carrier employees to their state of residence and any state where they earn more than 50% of pay, which matters directly for Arizona-based crew flying national routes.

Maine to Arizona FAQ

I own a lake house in Maine and visit a few months a year but live in Florida. Am I a Maine resident?+

Only if you cross both prongs of Maine's statutory-residency test: more than 183 days in Maine in the tax year, counting any part of a day, AND you maintained that lake house as a permanent, year-round abode rather than a seasonal camp used only for vacations. Maine's own published example (a retired couple with a Florida home who return to their Winthrop lakefront house from mid-April to late October, about 200 days) found exactly this pattern makes you a statutory resident even though you're domiciled in Florida.

Does Arizona use the 183-day rule?+

Not exactly. Arizona's statutory presumption under ARS §43-104 kicks in after more than nine months, roughly 274 days, of aggregate presence in a tax year, not 183 days. Spending fewer than 274 days doesn't automatically make you a nonresident either; Arizona still looks at your domicile and intent.

Does getting a Florida driver's license end my Maine tax residency?+

Not by itself. Maine Revenue Services weighs an extensive factor list, including your principal residence, where you spend the most time, spouse and dependents' location, and homestead claims, with no single factor controlling. A Florida license is one data point; if you still keep a year-round Maine home and spend significant time there, MRS can still find you domiciled in Maine or a Maine statutory resident.

How many months can I spend in Arizona as a snowbird before I owe Arizona income tax?+

Arizona's own presumption threshold is more than nine months (about 274 days) in the state during the tax year. Under that, you're not automatically presumed an Arizona resident, but your home state's own rules, for example California's nine-month presumption running the other direction, may still treat you as a resident there regardless of your Arizona day count.

No. Arizona fully exempts Social Security benefits from state income tax, regardless of your total income level.

Does Maine tax my Social Security or pension in retirement?+

Social Security is fully exempt from Maine tax. Pensions and 401(k)/IRA withdrawals qualify for a separate deduction (about $48,216 for 2025), but that deduction shrinks dollar-for-dollar by however much Social Security you already received, so retirees with substantial Social Security income get little added benefit from the pension deduction on top of it.
