Moving from Oregon to Delaware: Residency, Taxes, and What to Prove
The top income tax rate drops from 9.9% in Oregon to 6.6% in Delaware. Establishing Delaware residency correctly is what protects that benefit.
Residency Tests Side by Side
Oregon uses a 200-day statutory residency threshold, while Delaware uses 183 days. Track both thresholds separately during a transition year rather than assuming they line up.
| Factor | Oregon | Delaware |
|---|---|---|
| Statutory Residency Test | ORS 316.027 defines a resident as anyone domiciled in Oregon (unless they meet a narrow foreign-presence exception), or anyone who is not domiciled in Oregon but maintains a permanent place of abode in Oregon and spends more than 200 days of the tax year in the state, unless they can prove the presence was only temporary or transitory. | Under 30 Del. C. § 1103, an individual who maintains a place of abode in Delaware and spends in the aggregate more than 183 days of the taxable year in Delaware is a resident for that portion of the year, independent of domicile. This mirrors the classic New York-style 183-day-plus-abode formulation used across much of the Northeast and mid-Atlantic. |
| Domicile Test | Oregon follows the common-law domicile standard under Or. Admin. Code §150-316-0025: your permanent home, the place you intend to return to after any temporary absence. You can maintain multiple residences but only one domicile at a time, and domicile continues until affirmatively abandoned in favor of a new one, evidenced by concrete conduct rather than stated intent alone. | Delaware treats an individual domiciled in Delaware as a resident for the period of that domicile under 30 Del. C. § 1103. Domicile itself follows the common-law standard cited in Delaware practitioner guidance: the place a person intends as their permanent home and to which they intend to return, with a person able to hold only one domicile at a time; Delaware's statute does not publish an extensive itemized factor list the way Maine or New York do, so practitioners apply the general totality-of-circumstances domicile factors (home ownership, employment, family location, licensing, and consistent documentation across financial and civic records). |
| Day Count Threshold | 200 days | 183 days |
| Any Part of a Day Rule | Oregon's 200-day statutory residency test counts aggregate days present in the state; Department of Revenue guidance and case law (see Thompson v. Dept. of Revenue) focus on the totality of ties rather than publishing a strict any-part-of-a-day rule the way California does, but any day with meaningful presence counts toward the 200-day aggregate. | Not independently confirmed in the statutory text reviewed for this dossier; consult 30 Del. C. § 1103 and Division of Revenue guidance directly, but treat any Delaware presence conservatively as a full day for planning purposes, consistent with the norm in comparable 183-day-plus-abode states. |
| Presumptions | 200-day rule under ORS 316.027 for non-domiciliaries who maintain a permanent Oregon place of abode: more than 200 days of presence creates statutory residency regardless of domicile, unless rebutted as temporary or transitory. | None published |
| Safe Harbors | None published | Foreign residence exception to domicile-based residency |
Leaving Oregon
Oregon Department of Revenue audits are less publicized than California's but still substantive, particularly for people who sold an Oregon business or Oregon real estate near their claimed departure date. Oregon's own case law (Thompson v. Dept. of Revenue, White v. Dept. of Revenue) shows the Department looks past stated intent to continued use of Oregon utilities, insurance, and household services, and to whether the taxpayer actually took concrete steps like changing driver's license, voter registration, or filing status elsewhere.
Trailing Income
Oregon-source income, including income from an Oregon business, Oregon real property, and wages for work physically performed in Oregon, continues to be taxed to nonresidents after departure. Oregon's estate tax also continues to apply to Oregon-situs real and tangible property even after a decedent has become domiciled elsewhere, since real property is taxed where it sits regardless of the owner's domicile at death.

Common Exit Mistakes
Establishing Delaware Residency
| Action | Agency | Deadline |
|---|---|---|
| Get a Delaware driver's license | Delaware Division of Motor Vehicles (DMV) | within 60 days of establishing residency |
| Register vehicles | Delaware DMV | within 60 days of taking up residence (21 Del. C. § 2118) |
| Register to vote | Delaware Department of Elections | the 4th Saturday before a Primary or General Election |
Declaration of Domicile
Delaware has no formal declaration-of-domicile filing comparable to Florida's. Domicile is established through conduct: obtaining a Delaware driver's license and vehicle registration, registering to vote, and maintaining a Delaware address as the address of record on financial, employment, and legal documents.
Homestead
Delaware has no broad homestead exemption reducing assessed property value the way Florida or Maine does. Its very low average effective property tax rate (roughly 0.50%-0.54%) already limits the practical stakes of the issue, but this also means Delaware offers no homestead-style filing that would otherwise serve as strong, easily documented evidence of domicile for a new resident.
Voter Registration
Register online through ivote.de.gov, in person at the DMV or a Department of Elections office, or by mail; the deadline is the 4th Saturday before a Primary or General Election under Delaware Code. https://ivote.de.gov

New Resident Tax Traps
A new Delaware resident is taxed on worldwide income from the date domicile shifts, the standard rule. The distinctive Delaware trap runs the other way for people moving OUT while keeping a Delaware employer: Delaware's convenience-of-the-employer rule means a new Delaware resident who works remotely for an out-of-state employer generally faces no special Delaware trap, but anyone leaving Delaware for a Delaware-based job needs to plan for the reverse issue at exit.
What Changes on Tax
Oregon Top Rate
9.9%
Delaware Top Rate
6.6%
Moving from Oregon to Delaware drops the top marginal income tax rate from about 9.9% to about 6.6%, a reduction of roughly 3.3 percentage points.
Withholding Reciprocity
Oregon and Delaware do not have a wage-withholding reciprocity agreement with each other, so this move follows ordinary source-state and resident-state filing rules rather than a reciprocity exception.
Community Property Transition
Oregon and Delaware both use common law, equitable-distribution marital property rules, so no community property transition applies to this move.
Beyond Income Tax
Oregon
Capital gains: Taxed as ordinary income at the same 4.75% to 9.9% brackets, with no separate or preferential long-term capital gains rate.
Estate or inheritance tax: Oregon has an estate tax with an unusually low $1 million exemption threshold, one of the lowest in the country. Rates are graduated from 10% up to 16% on the value above $1 million. There is no separate inheritance tax.
Property tax: Statewide median effective rate is roughly 0.87%, with Portland running higher at about 1.08% and Multnomah County around 0.98%, driven by layered school district, city, county, and Metro levies. Measure 50 caps annual assessed value growth at 3% regardless of market appreciation.
Sales tax: Oregon is one of only five states with no state or local sales tax of any kind.
Delaware
Capital gains: Taxed as ordinary income with no separate Delaware capital gains rate or broad exclusion; a capital gain is added to Delaware taxable income and taxed at the same graduated rates as wages, up to 6.6%.
Estate or inheritance tax: None. Delaware repealed its estate tax effective January 1, 2018, and has no separate inheritance tax, making it one of the more estate-tax-friendly mid-Atlantic states alongside its long-standing reputation for trust-friendly law through the Delaware Court of Chancery.
Property tax: Delaware has one of the lowest average effective property tax rates in the country, commonly cited around 0.50% to 0.54% of home value, the product of county assessments in New Castle, Kent, and Sussex counties that have gone many years between full reassessments.
Sales tax: None. Delaware has no state or local sales tax at all, a signature draw for the Wilmington-area shopping corridor that pulls consumers from Pennsylvania, New Jersey, and Maryland.
Who This Move Applies To
Travel Nurses
In Oregon
Portland-area hospital systems are a significant travel nursing market, and Oregon's no-sales-tax status has no bearing on income tax exposure for nurses working Oregon contracts. A nurse's tax home has to be a genuine, regularly used residence with duplicated living expenses to support tax-free stipend treatment; an Oregon-domiciled nurse working travel assignments elsewhere remains an Oregon resident taxed on worldwide income unless domicile is affirmatively changed.
In Delaware
Delaware has no nurse-specific tax-home guidance; the general IRS tax-home rules under Publication 463 govern whether stipends stay tax-free, and Delaware's own residency status for a nurse turns on the same 183-day-plus-abode or domicile tests everyone else faces under 30 Del. C. § 1103.
Professional Athletes
In Oregon
The Trail Blazers are Oregon's major professional franchise. Oregon applies standard duty-day allocation to nonresident athlete income at rates up to 9.9%, among the higher jock-tax burdens nationally given Oregon's steep top bracket, though Oregon-based players avoid a second layer of sales tax that would apply in most other NBA cities.
In Delaware
Delaware has no major professional sports franchises, so it runs no state-specific jock-tax apportionment regime. A Delaware-domiciled athlete owes Delaware tax on worldwide income (with credits for tax paid to other states on away-game duty days) but faces no in-state team creating reciprocal audit interest from opposing states.
Snowbirds, Long Visitors, and RVers
In Oregon
Oregon's 200-day rule is narrower than most states' snowbird thresholds: a non-domiciliary who maintains a permanent Oregon place of abode and spends more than 200 days in the state becomes a statutory resident even without ever forming domiciliary intent. This makes Oregon less forgiving than a nine-month (roughly 274-day) presumption state for anyone splitting time with a retained Oregon home.
In Delaware
Delaware's beach communities (Rehoboth, Bethany, Lewes) draw significant seasonal second-home ownership from Pennsylvania, Maryland, and Washington D.C. Anyone who keeps a Delaware beach house and crosses 183 aggregate days of Delaware presence in a year, while maintaining that home as a place of abode, becomes a Delaware statutory resident regardless of where they claim domicile, the same mechanic that applies in New York or Vermont.
Remote Workers
In Oregon
Oregon has no convenience-of-employer rule. A nonresident performing all their work physically outside Oregon for an Oregon-based employer is not Oregon-taxed on those wages. This matters heavily for the many Washington residents who work for Portland-based employers: wages for days physically worked in Oregon are Oregon-taxable, but days worked remotely from a Washington home office generally are not, which is the structural reason so many Portland-area workers live just across the Columbia River in Vancouver, Washington.
In Delaware
This is Delaware's most distinctive special-situation fact: Delaware applies a convenience-of-the-employer rule, treating work done from home by an employee of a Delaware-based company as Delaware-source income whenever the remote arrangement is for the employee's own convenience rather than a genuine employer requirement. Combined with no reciprocity agreements with any neighboring state, this leaves remote workers for Delaware employers in Pennsylvania, New Jersey, or Maryland at real risk of double taxation unless their home state grants a full credit for the Delaware tax.
Military
In Oregon
Oregon follows the federal Servicemembers Civil Relief Act and Military Spouses Residency Relief Act. Nonresident military stationed in Oregon under orders don't become Oregon residents from the posting alone. Oregon does tax military retirement pay as ordinary income for Oregon-domiciled veterans, unlike Arizona, which fully exempts it, a distinction that matters for military retirees choosing between the two states.
In Delaware
Delaware follows the federal SCRA and MSRRA framework: a service member's home-of-record does not change solely because military orders station them in Delaware, and an accompanying spouse can generally elect the service member's domicile state under MSRRA for tax purposes.
Airline Crew
In Oregon
Portland International Airport (PDX) hosts crew bases for Alaska Airlines and other carriers. Federal law (49 U.S.C. §40116) limits taxation of air carrier employees to their state of residence and any state where they earn more than 50% of pay, protecting Oregon-based crew flying multistate routes from Oregon taxing 100% of their income.
In Delaware
Delaware has no major hub airport for airline crew bases, though its proximity to Philadelphia International makes Delaware a common domicile choice for crew who want to avoid Pennsylvania's local wage taxes. The federal carve-out under 49 U.S.C. § 40116 (crew wages taxable only by the state of residence or a state earning over 50% of pay) governs regardless.

Oregon to Delaware FAQ
Does Oregon use the 183-day rule?+
No. Oregon's statutory day-count threshold is 200 days, not 183, and it only applies to people who are not domiciled in Oregon but who maintain a permanent Oregon place of abode. If you're Oregon-domiciled, the 200-day rule doesn't even apply; you're a resident based on domicile alone regardless of day count.
I work remotely from Pennsylvania for a Delaware company. Does Delaware still tax my wages?+
Likely yes, if the remote arrangement is for your own convenience rather than something your employer requires. Delaware's convenience-of-the-employer rule treats income as Delaware-source in that situation, which means you may owe Delaware tax on those wages even though you never work physically in Delaware, and you'll want to confirm Pennsylvania grants a credit for the Delaware tax to avoid paying twice on the same income.
Can I live in Washington and work in Portland without paying Oregon income tax?+
Only on the portion of wages for days you physically worked outside Oregon. Oregon taxes wages for days you physically worked within Oregon regardless of where you live, so a Washington resident commuting into Portland for in-office work owes Oregon tax on those workdays, while remote workdays performed from a Washington home office generally don't.
How does Delaware's 183-day residency test actually work?+
Under 30 Del. C. § 1103, you're a Delaware resident for tax purposes if you maintain a place of abode in Delaware and spend more than 183 aggregate days in the state during the tax year, regardless of where you consider yourself domiciled. This is separate from, and in addition to, being taxed as a resident because you're actually domiciled in Delaware.
Does Oregon have a sales tax?+
No. Oregon is one of only five states with no state or local sales tax at all, which is a major reason it draws cross-border shoppers from Washington and California.
I own a beach house in Rehoboth and visit often but live in Maryland. Am I a Delaware resident?+
You could be, if the Rehoboth house counts as a 'place of abode' you maintain and your total time in Delaware across the year exceeds 183 days, even split across multiple visits. Delaware's statutory-residency test doesn't require the home to be your primary residence, just a place of abode you keep, combined with the day count.
What's the Oregon kicker and does it depend on residency?+
The kicker is a unique Oregon mechanism that refunds excess state revenue as a tax credit when actual collections exceed the state's forecast by 2% or more. It's unrelated to your residency status; it's calculated off your prior-year Oregon tax liability.
Does Delaware have an estate tax I need to plan around?+
No. Delaware repealed its estate tax effective January 1, 2018, and has no separate inheritance tax. Only the federal estate tax can apply to a Delaware domiciliary's estate above the federal exemption.
Does Oregon tax Social Security?+
No. Oregon fully exempts Social Security benefits from state income tax, though pensions and 401(k)/IRA withdrawals are generally taxed as ordinary income at rates up to 9.9%.
Does Delaware tax my Social Security or pension in retirement?+
Social Security is fully exempt from Delaware tax. Delaware also allows a pension and retirement income exclusion of up to $12,500 per person for taxpayers 60 or older, covering pensions, 401(k), and IRA withdrawals; amounts above that exclusion are taxed at Delaware's ordinary rates, up to 6.6%.
How does Oregon prove I never actually left?+
Oregon's own case law shows the Department of Revenue looks at continued Oregon utility, insurance, cable, and household service accounts, along with whether you actually changed your driver's license, voter registration, and moved your belongings, not just what you say your intent was.
I'm domiciled in Delaware but work abroad most of the year. Do I still owe Delaware tax?+
You may qualify for Delaware's foreign-residence exception: if within any consecutive 18-month period you're present in a foreign country at least 495 days, present in Delaware no more than 45 days, don't maintain a Delaware abode where your family stays more than 45 days, and aren't a federal government or military employee, Delaware treats you as a nonresident for that period despite your domicile.
Considering the reverse move?

Moving the other direction is a different fact pattern, not a mirror image: exit risk and establishment mechanics both flip.
